Flood Form Inc.
Terms of Service
Effective Date: June 17, 2025 · Last Updated: June 17, 2025
These Terms of Service ("Terms") govern access to and use of the Flood Form web application (the "Platform"), available at https://floodform.nyc, and any associated reports, datasets, maps, analyses, recommendations, or services provided by Flood Form Inc. ("Flood Form," "we," "our," or "us").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
1. Purpose of the Platform
Flood Form is an informational and planning resource intended to assist property owners, community organizations, researchers, public agencies, and policymakers in understanding flood exposure and evaluating potential stormwater management strategies.
The Platform provides synthesized analyses based on proprietary methodologies developed by Flood Form. It is not intended to serve as engineering certification, legal advice, or a substitute for site-specific professional services.
2. Ownership and Intellectual Property
All content available through the Platform, including but not limited to:
- flood exposure scores
- infiltration suitability ratings
- compound exposure calculations
- evaluation methodologies
- weighting systems
- prioritization frameworks
- maps and visualizations
- generated reports
- recommendations
- written content
- graphics
- custom databases
- organizational structures and solution frameworks
are the exclusive property of Flood Form or its licensors and are protected by applicable intellectual property and contract law.
While portions of the software code used to implement the Platform may have been generated or assisted through artificial intelligence tools, the underlying datasets, analytical methodologies, field observations, validation processes, scoring systems, decision frameworks, and planning recommendations are the result of substantial human research, professional judgment, and original authorship by Flood Form.
No ownership rights are granted except those expressly described in these Terms.
3. Limited License
Subject to these Terms, Flood Form grants users a limited, revocable, non-exclusive, non-transferable license to:
- access the Platform;
- view reports and maps;
- use generated information for personal, educational, governmental, nonprofit, or internal planning purposes; and
- share individual reports with proper attribution.
This license does not permit redistribution of the underlying datasets or replication of the Platform.
4. Prohibited Uses
You may not, directly or indirectly:
- scrape, crawl, spider, harvest, or systematically collect data from the Platform;
- use bots or automated software to query or extract information;
- build or train machine learning or artificial intelligence models using Platform outputs;
- reproduce or reverse engineer Flood Form's scoring methodologies or evaluation framework;
- compile large collections of reports for database creation;
- create derivative flood scoring products substantially similar to Flood Form;
- copy or recreate the Platform's prioritization methodology;
- use Platform outputs to build competing commercial products or services;
- circumvent rate limits or technical protections;
- access the Platform through unauthorized APIs or automated interfaces; or
- use the Platform in any manner intended to replicate its analytical capabilities.
These restrictions apply regardless of whether individual data elements might otherwise be publicly available from governmental sources.
5. No Data Harvesting
The value of Flood Form derives not merely from public datasets but from the proprietary selection, cleaning, validation, weighting, integration, interpretation, and application of those datasets into actionable planning tools.
Accordingly:
- bulk downloading is prohibited;
- automated extraction is prohibited;
- systematic querying designed to reconstruct the underlying database is prohibited; and
- repeated requests intended to replicate Flood Form's evaluations are prohibited.
Attempts to reconstruct or reproduce the Platform through systematic collection of outputs constitute a material violation of these Terms.
6. Commercial Use Restrictions
Unless expressly authorized in writing by Flood Form, no user may:
- resell Platform outputs;
- integrate Platform results into commercial software;
- redistribute generated reports as part of a paid service;
- create subscription products based substantially on Platform outputs;
- use Platform evaluations for commercial lead generation; or
- incorporate Platform analyses into competing consulting services.
Organizations wishing to license data or methodology should contact Flood Form directly.
7. Public Data Does Not Waive Rights
Many source datasets incorporated into Flood Form originate from public agencies. However, Flood Form's integration of multiple datasets, quality assurance procedures, scoring algorithms, prioritization metrics, analytical weighting, decision matrices, human interpretation, recommendations, and report generation framework constitute proprietary intellectual work independently protected under these Terms.
The public nature of certain source data does not grant permission to reproduce or appropriate Flood Form's analytical products.
8. Attribution
When citing Flood Form analyses or reports, users should attribute them substantially as:
Source: Flood Form Inc., Flood Form Compound Flood Exposure Mapping Tool.
Modification or redistribution without attribution is prohibited.
9. Accuracy and Disclaimer
Flood Form provides planning-level information derived from available datasets and professional interpretation. Conditions on individual properties may differ materially from mapped conditions.
No guarantee is made regarding:
- completeness;
- accuracy;
- future flooding;
- engineering performance;
- permitting outcomes; or
- insurance eligibility.
Users should obtain qualified engineering or professional advice before undertaking construction or relying upon Platform outputs for regulatory compliance.
10. No Professional Relationship
Use of the Platform does not establish:
- an engineer-client relationship;
- landscape architect-client relationship;
- consultant-client relationship; or
- attorney-client relationship.
Professional services require a separate written agreement.
11. Enforcement
Flood Form reserves the right to:
- suspend or terminate access;
- block automated requests;
- restrict abusive users;
- pursue contractual remedies;
- seek injunctive relief; and
- recover damages and attorneys' fees where permitted by law
for violations of these Terms. Unauthorized scraping or commercial replication may cause irreparable harm that monetary damages alone cannot adequately remedy.
12. Changes to the Terms
Flood Form may modify these Terms at any time. Continued use of the Platform following publication of revised Terms constitutes acceptance of those revisions.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and users consent to the jurisdiction of those courts.
